Terms of Service

1. Scope and parties

(1) These terms govern all contracts on the use of the "elftipp" web application between Nils-Ole Kief, Neugärtenring 17, 68766 Hockenheim, Germany ("provider") and the person setting up and running a prediction round ("host"). A host may be a private individual (consumer) or a business (e.g. bar, club, company, event organiser).

(2) Players in a prediction round do not enter into a contract under these terms; the player rules apply to them. Playing is always free of charge.

(3) Deviating terms of the host do not become part of the contract unless the provider expressly agrees in text form.

2. Services

(1) elftipp is a web application that lets the host run a prediction and manager round for football competitions (including the Bundesliga, Premier League, LaLiga). Players join via link or QR code, predict free of charge and see a live-updated ranking.

(2) Setting up and running a private prediction round is free. Chargeable are only optional extras (e.g. custom branding, big-screen mode, ready-made graphics) and offerings for the commercial setting (bar, club, company, event) — as described in the booking area ("paid services").

(3) The scope of paid services follows the service description valid in the booking area at the time of booking.

(4) Match and sports data shown (fixtures, results, statistics) come from external data providers. elftipp is independent and not affiliated with any league, association or club.

3. Account and access

(1) Setting up a prediction round requires an account. Sign-in works via a login link sent to the host's email address; no password is issued.

(2) The host keeps their email address up to date and protects access to their mailbox.

4. Conclusion of contract for paid services

(1) The presentation of packages in the booking area is not a binding offer but an invitation to order.

(2) The contract for a paid service is concluded when the host completes the order by clicking the button labelled "zahlungspflichtig bestellen" (order with obligation to pay) and the provider accepts the order by activation or confirmation in text form.

(3) Free use never converts automatically into a paid contract. A payment obligation arises only through an active booking.

5. Prices and payment

(1) The prices shown in the booking area at the time of ordering apply. All prices are final; under Section 19 of the German VAT Act (small business scheme) no VAT is shown.

(2) Payments are processed via Stripe. Paid services are activated after receipt of payment.

6. Term and termination

(1) One-off packages (e.g. for a single event) end automatically at the end of the booked period; no notice is required.

(2) Subscriptions renew for the booked billing period until cancelled. The host may cancel a subscription at any time with effect from the end of the current billing period.

(3) Consumers can additionally cancel subscriptions via the "Verträge hier kündigen" (cancel contracts here) button on the website (Section 312k German Civil Code). A declaration in text form (e.g. email to kontakt@elftipp.com) is always sufficient as well.

(4) The right to extraordinary termination for good cause remains unaffected.

(5) The host may stop free use at any time; it has no fixed term.

7. Right of withdrawal for consumers

If the host is a consumer, the following right of withdrawal applies to paid services. Businesses have no right of withdrawal.

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise the right, you must inform us (Nils-Ole Kief, Neugärtenring 17, 68766 Hockenheim, Germany, email: kontakt@elftipp.com) of your decision by an unequivocal statement (e.g. an email). You may use the model withdrawal form in the German AGB, but it is not obligatory. Sending your notification before the period expires is sufficient.

Effects of withdrawal. If you withdraw, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day we receive your notification, using the same means of payment, free of charge for you. If you requested that the service begin during the withdrawal period, you shall pay us an amount proportionate to the services already provided.

Early expiry. The right of withdrawal expires for service contracts once we have fully performed the service, if performance began only after your express consent and your confirmation that you lose the right of withdrawal upon full performance.

8. Free participation of players — stakes are prohibited

(1) Playing in a prediction round is always free of charge. elftipp is not gambling: no stakes are collected, no prize pools are formed and no money prizes are paid out via the application.

(2) The host is prohibited from making participation directly or indirectly conditional on any payment or other consideration by players (entry fee, increased admission or minimum-spend), from forming prize pools out of player contributions, and from operating the round as paid gambling or betting in any other way.

(3) In case of a violation, the provider may suspend the affected round and terminate the contract for cause. The host indemnifies the provider against third-party claims based on such use.

9. Prizes offered by the host

(1) The host may voluntarily offer own prizes (e.g. free drinks, vouchers, non-cash prizes), provided participation remains free (clause 8).

(2) Prizes are exclusively a matter between the host and the players. The application only displays them; the provider does not handle money or redemption.

(3) The host is responsible for compliance of offered prizes with the law — in particular rules on prize-competition conditions and youth protection (e.g. no alcoholic prizes for minors).

10. Host obligations, content

The host uses the application responsibly and lawfully, and works to prevent unlawful content (e.g. offensive nicknames) in their round. The provider may remove unlawful content and suspend players.

11. Availability, sports data and refunds

(1) The provider aims for high availability but does not owe uninterrupted availability. Maintenance, connectivity issues and outages of upstream third parties (hosting, sports data) are outside the provider's control.

(2) No warranty is given for accuracy or timeliness of externally sourced match data. Individual matches not scored, or scored late, due to external data outages do not in themselves give rise to a refund claim.

(3) Minor disruptions give no refund claim. For significant unavailability attributable to the provider, the host may demand a reasonable reduction; for outage of the substantial part of the booked period, withdrawal and pro-rata refund. Statutory consumer rights remain unaffected.

12. Liability

(1) The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

(2) For slight negligence, the provider is liable only for breach of essential contractual obligations, limited to typical, foreseeable damage.

(3) Any further liability is excluded.

13. Privacy

See the privacy policy. The provider is the data controller for player data processed in the game.

14. Final provisions

(1) German law applies. For consumers, this choice of law does not deprive them of the protection of mandatory provisions of the state of their habitual residence.

(2) If the host is a merchant, the exclusive place of jurisdiction is the provider's seat (Hockenheim, Germany).

(3) The provider is neither willing nor obliged to participate in consumer arbitration proceedings (Section 36 VSBG).

(4) Should any provision be invalid, the remainder of the contract remains valid.
